Tutor City: Terms and Conditions

Terms & Conditions for Parent / Student

Key points:

1. There is no contract to complete a certain number of lessons, therefore you can terminate the tuition anytime and only pay for the lessons given by the tutor. There is also no free lesson and you will have to pay for every lesson provided by the tutor.

2. There is a 50% commission of the first month charged to the tutor but collected from you. No other charges is levied.

Tutor Profiles
a) Tutor City attempts to be as accurate as possible. However, Tutor City does not guarantee that the description of the tutor is accurate, complete, reliable, current, or error-free.
b) Tutor City provides the tutor database for online viewing as it is.
c) You are required to check the credentials and certificates of the tutor on the first lesson if the scanned copy is not available on our site. It is your responsibility to ensure that the tutor's credentials and qualifications are satisfactory.

Availability of Preferred Tutors
a) Tutor City does not guarantee that the client will be assigned his / her preferred tutor(s) as this depends on the availability of the preferred tutors.
b) Tutor City does not guarantee that the client will be assigned his / her preferred tutor(s) even if the tutor has indicated availability in his /her online schedule for the selected timeslots.

Place of Tuition
a) The assigned tutor will teach at the residence of the client by default unless otherwise indicated by you and you are to provide a reasonable environment for the conduct of lessons.

Tuition Rates
a) The rates stated on our website are obtained based on tutors' recent quotations and therefore should only serve as a guide. Tutors charge different rates depending on their qualifications and experience.
b) The rate stated is fairly accurate as it is based on the current market rates and is reviewed frequently.
c) These rates are non-negotiable for the first month.
d) Tutor City reserves the right to amend the rates at any time.
e) The rates are fixed for the first month. After the first month, the rates can be re-negotiated.
f) If the tutor tries to change the tuition rates, please inform Tutor City immediately.

Performance and Changing of Tutor
a) There is no obligation or contract to complete a fixed number of lessons.
b) Although the tutor is expected to help improve the student’s grades, Tutor City cannot guarantee improvement in the student's grades as there are factors beyond Tutor City’s control.
c) Nonetheless, if you wish to change your tutor for any reason, you can do so at no additional charge. To be fair to the tutor, you will need to pay for the number of lessons given prior to termination.  

Payment Information
a) Tutor City charges a commission to the tutor which is equivalent to 50% of the fees for the first month or 50% of the amount of the lessons given if the service is terminated before completion of the first month.
b) Tutor City will collect the commission charges from you and will issue an invoice by hand / mail / email. You have two weeks to make payment from the date the bill is sent.
c) You can pay the tuition commission via ATM transfer / Internet Banking / Cheque / Cash. Details of the payment will be made available in the invoice which will be sent to you via email or post.

Short-term tuition
a) We provide tutors on a short-term basis (12 lessons or less) e.g. preparation for test/essay/presentation.
b) For short-term tuition, the agency commission will be charged to you and the amount will be agreed upon on a case-to-case basis. As a guideline, the amount is equivalent to 2 lesson fees of 1.5 hours (Hourly rate x 3 hours ).
c) The reason is that the tutor's total earnings would be greatly reduced if the agency commission is deducted from them and there are no future lessons to recoup this amount, thus tutors generally do not want to pay the agency commission. You may discuss with us if you wish to know more about this arrangement.

Terms & Conditions for Tutors

Key points:

1. Tutor City will charge a commission of 50% of the first month fees (usually the first 4 / 8 / 12 lesson fees) from you for each successful assignment which we will collect from the client. You will teach at the place designated by the student / parent.

2. Please be truthful about your qualification that you state as the parent may request to see your certificate on the first lesson.


3. By registering with our agency, you also declare to be free of criminal records and are not being charged with any offence in a court of law in Singapore (excluding parking offences). 

4. Your basic profile will be displayed in our 'Search Tutors' page for parents to shortlist, where only a limited amount of information is shown (name, age, gender, schools attended, experience, commitment and photo). Personal details such as your phone number, email, address will not be displayed. If you wish to unsubscribe or remove your details, please contact us immediately.

Registration
Registering as a tutor with Tutor City is free. The minimum age is 18 years old and you have to reside in Singapore. Tutor City reserve the right to reject your application.
All contents such as text, photographs, graphics, messages are the sole responsibility of the tutor from which such content originated. Therefore, you are entirely responsible for all content that you post, upload, email or make available via Tutor City's website.
The certificates that you upload on our registration form is for the administrator to verify the accurary of your qualifications and will not be sent to parents or any third-party.
You are responsible for maintaining the confidentiality of your account and password and you agree to accept responsibility for all activities that occur under your account or password.
Tutor City cannot and will not be liable for any loss or damage arising from your registration as a tutor. Tutor City reserves the right to edit and remove content in your Tutor account or terminate accounts. Tutor City is not liable for any unforeseen circumstances that may arise from the assignment.

Contacting you for assignments
You may receive a call or SMS broadcasts of new assignments and first lesson reminders. However, Tutor City cannot guarantee that you will receive SMS broadcasts as it is dependent on your profile and client's preference.
Tutor City does not guarantee that you will be selected for the assignment after you have responded to the SMS broadcast.
If you are shortlisted, we will contact you for further discussion. If you are not selected, we have no obligation to contact you.

First Lesson and Assignment
You are expected to contact the client before the first lesson for re-confirmation of the lesson.
Failure to turn for the first lesson or any other reasons caused by you resulting in the cancellation of the assignment will lead to the termination of your tutor account. This will be evaluated on a case-by-case basis.
The client can stop the tuition at any time. You can expect to receive payment for any amount of lessons rendered unless the client is dissatisfied with the lesson.
If the assignment is cancelled immediately after the first lesson for any reason whatsoever, please refer to the next section on 'Commission' for the settlement of the commission.

Commission
The fees are fixed for the first month. No negotiation is allowed once the fees have been set.
Tutor City will collect 50% from the first month as commission at the end of the 2nd week's lessons. It may be the completion of 4, 8 or 12 lessons (depending on the frequency of the tuition assignment).
If lessons are postponed during the 4-weeks, the postponed lessons are not counted in the commission. Example: During the 4 weeks of 8 lessons, 1 lesson was postponed by the client. Tutor City will still collect based on 8 lessons and not 7 lessons.
If there are any changes to the frequency of lessons for the first month or in the second month, the commission collected depends on whether the frequency was increased or decreased. The commission will be negotiated on a case-by-case basis.
Any attempt to avoid payment of the commission or unreasonable demands will result in the termination of your account.
Tutor City will not collect any upfront payment from the client and we do not allow instalment plans.
Cancellation by tutor or Client cancel due to fault of tutor: If tutor cancels the assignment during the first month of tuition, the tutor will still pay the commission which is equivalent to 50% of the first 4 / 8 / 12 / 16 lessons as stated in the confirmation SMS. Any surplus beyond the first 50% of the tuition fees will then be paid to the tutor.
Cancellation by client (no fault of tutor): If client cancels the assignment during the first month of tuition, the tuition fees will be collected by the agency and divided equally between the agency and the tutor.

Conduct of Tutor
Although Tutor City has no legal jurisdiction over the conduct of the tutors, certain penalties will imposed on tutors who display poor conduct.

Certain areas to highlight:

Punctuality. If the client complains that the tutor is frequently late or leaves before the lesson is completed, Tutor City has the empowerment to stop the assignment and/or close the tutor's account at any time.

'No-shows'. This is severe and tutors who did not turn up for the lesson without informing the client through a phone call or in person will have their account closed. SMS or emails are not considered as a means for informing the client.

Be professional. Tutors must concentrate on the lesson at all times. Client who complains that the tutor is frequently distracted e.g. doing personal things, SMSing, chatting, will be warned or Tutor City may stop the assignment and/or close the tutor's account at any time.

Dress code. Bear in mind that the client has the right to reject a tutor due to inappropriate dressing. Therefore, please dress appropriately at all times.

Tutor City will try our utmost to be fair to the tutor. Any complaints lodged against the tutors will be investigated and we will seek clarifications with the tutor to allow the tutor to defend himself / herself.

Please be assured that Tutor City considers the privacy of your personal information a subject of utmost importance. Personal information includes but is not limited to your name, telephone number, handphone number, email address, home address as well as any information you have provided to Tutor City.

By providing your personal information to us, you therefore give consent to receiving phone calls, SMSes or emails from our coordinators in the tuition-matching process. Tutor City knows you care how information about you is used and shared, and we appreciate your trust that we will do so carefully and sensibly
